Ken DeStefano was a magna cum laude graduate of Boston College, where he was named Scholar of the College and Outstanding Philosophy Student. In addition to his philosophy degree, Ken earned a bachelor’s degree in Economics. His education continued when he earned his law degree from NYU Law School.

Ken made the move from complex litigation association to Labor and Employment Law when he became Counsel for the Rockland County Sheriff in 2003. At the Sheriff’s Office, he oversaw all labor and personnel matters for the Rockland County Sheriff, focusing on the disciplinary investigations and hearings.

He fully litigated matters including:

  • Theft of inmate property;
  • Log Falsification;
  • Multiple instances of failure to super vise and/or follow procedures (one leading to a successful suicide attempt and another leading to an unsuccessful suicide attempt);
  • Gross misconduct (arising from a high-profile incident involving the Chaplain’s distribution of anti-Islamic literature to inmates);
  • Filing of false accident/injury report; and
  • Submission of fraudulent time sheets.

Ken maintained strong and respectful relationships with union leaders during his time representing the Sheriff.

Ken next moved on to NYSUT, his current employer. At NYSUT, he began defending union members in the disciplinary process. Some of the matters he defended involved:

  • Members facing charges of failure to properly supervise a student (who raped another student in the bath room);
  • Misuse of district-provided cellphone;
  • Lateness;
  • Incompetence; and,
  • Theft.

Ken also trained other NYSUT employees on brief writing, arbitration techniques, and effective legal research methods. He trained local leaders to properly represent members subject to investigation, better advocate for their members, and bargain more effectively.

While at NYSUT, Ken developed an expertise in health insurance. He has earned certificates from the International Foundation of Employee Benefit Plans in Health and Welfare Plans, Health Care Cost Management and Trustee Institute Levels I and II. Ken has testified before a Joint Committee of the NYS Senate and Assembly about the impact of health reform on union members, and regularly services NYSUT's Field, Legislative and Office of General Counsel in all matters relating to health insurance.

Ken was an adjunct professor at St. Thomas Aquinas College, and is admitted to practice in New York and New Jersey, as well as the Southern and Eastern Districts of New York and the District of New Jersey. In his free time, Ken competes in open-water swim competitions, including one from Alcatraz prison to the San Francisco Marino, and two from the Statue of Liberty to Liberty State Park in Jersey City.
